对我国遗失物制度中侵权责任的思考

The Deliberation of Tortious Liability in Lost Property System

遗失物拾得人的侵权行为有据为己有、拒不返还、无权处分和毁损灭失等四种类型。为预防和减少侵权行为的发生,应当在债权关系和物权变动方面对我国现行遗失物制度进行补充与完善。

The lost property keepers＇ torts include appropriation,refuse to return,unauthorized disposition and damage or lost.For prevent and reduce the occurrence of torts,It should enrich and perfect the current lost property system about the relationship of creditor＇s right and real right alternation.
