法官解释:服从抑或创造

The judge's interpretation:to obey or to create

在法官解释法律的过程中,服从法律文本是法官的天职;同时,需要丰富智慧的创造性解释,对于法律的发展和进化意义重大。于是,司法过程中,便产生了两难:法官是该严格地服从法律,抑或创造性地解释法律。我们应该采取有效的措施,以避免冲撞。现实的出路是:服从应该被摆放在第一位,而必要时候的创造应当在法治的轨道之上。这个过程中,法官要科学地运用各种解释方法。

In the process of interpreting the law by the judge,obeying the legal texts is the bounden duty of the judge;at the same time,need a wise creative interpretation, which is of legal significance for the development and evolution of the law. Thus,in the judicial process,they had a dilemma：whether the judge should strictly obey the law or creatively interpret the law.We should take effective measures to avoid collision.Realistic way is：to obey should be placed first,and when necessary the creation should be on track of the rule of law.In this process,the judge should scientifically use a variety of ways of interpretation.
