摘要
依法行政是建设法治政府的核心。而形成以人为本的现代性法律体系乃是依法行政得以实现的必要条件。虽然我国已宣告中国特色社会主义法律体系"已经形成",但绝不意味着我国的法律体系已经尽善尽美。现阶段我国的法律体系依然还存在一定的局限性,与以权利的保障性、完备性、系统性、开放性、动态性和无矛盾性为基本特征的现代性法律体系相较,我国的法律体系依然还需要逐步加以完善。
Law-based administration is the core to construct a government of law.And,the construction of modernly human-oriented legal system is indispensable criteria to achieve law-based administration.Although China has declared the formation of socialist legal system with Chinese characteristics,but it doesn＇t mean legal system has reached perfection in China.Currently,Some limitation still existed in China＇s legal system.Compare to modernly legal system which basicly characterized by rights of indemnificatory,completeness,systematicness,openness,dynamics,consistency.China＇s legal system still need improve gradually.
