摘要
《中华人民共和国劳动合同法》中的无固定期限劳动合同条款,是社会各界争议的焦点。虽然已有着3年多的制度实施,无固定期限劳动合同的签订率仍然非常低下,这对于建立一个和谐稳定的劳动关系影响非常之大。文章通过介绍本文通过介绍《中华人民共和国劳动合同法》出台后无固定期限劳动合同的实施情况及其存在问题,结合国外的实践基础上,就完善我国无固定期限劳动合同制度提出若干思路,以期通过无固定期限劳动合同的实施构建我国和谐劳资关系,促进企业与员工的共同发展。
The PRC Labor Contract Law is particularly paid attention by the society,and the Flexible-term Labor Contract is especially the focus of dispute.Although having been implemented for more than two years,the signing rate of Flexible-term Labor Contract is still very low.The low efficiency operating state of Flexible-term Labor Contract's Implementation effects greatly the establishment of harmonious and stable labor relations.This article provides some suggestions on further improvement of Flexible-term Labor Contract on the basis of introduction of the implementation state after the enactment of Labor Contract Law and the analysis of the causes,so as to enable the Flexible-term Labor Contract become the mainstream of our country's labor contract relations,promote the common development of both enterprises and employees and build a harmonious and stable labor relations.
