摘要
特殊儿童的教育权利的特殊性,主要在权利主体、权利本质以权利救济等方面得以体现。这些也是特殊儿童教育权利获得救济的前提和基础。对特殊儿童权利的救济难以依靠传统民事救济制度得以实现,还需要援引惩罚性的损害赔偿机制。
It has some special characteristics with special children＇s rights to education under the framework of rights,such as the special subject of rights,the special essence of rights,the special remedy of rights,etc..These elements are foundations of special children＇s rights to education with different remedies.However,only relying on traditional civil remedy systems couldn＇t fulfill rights to equal education and special education needs.Therefore,it should operate some other systems such as exemplary damages for infringement system,to solve disputes of educational rights with special children who are weakness in current society.
