论公众参与视野中的地方立法调研

On the Local Legislative Research of the Public Participation

运用归纳分析、实证分析、价值分析等方法,论证了地方立法调研的公众参与价值。认为地方立法调研具有立法民主和科学统一的价值、道德上的善与真统一的价值,因而具有道德的正当性。立法调查研究使立法从立法时机、立法内容两方面更准确回应社会的需要,具有满足现实需要的正当性和提高立法质量、确保法律实现的价值。但现行地方立法调研制度供给不足,影响了地方立法的民主性、科学性。因此,应当加大地方立法调研适用、调研主体、调研方式选择、调研程序、调研的立法效力等方面的立法调研制度供给。

In order to explore the local legislative research as a public participation and what kind of institutional supply should be provided,various methods,such as inductive analysis,positive analysis,and value analysis,have been used to illustrate the value of the public participation in the local legislative research,to analyze the shortages of the current legal system supply on it,and in the end,to put forward some reasonable proposals.This paper concludes that the local legislative research has the value of the combination of democracy and science,the unity of virtue and truth,and it can satisfy the justification of the social needs,and improve the legislative quality and ensure the implementation of the legislation.But the shortage of the current legislative supply has influenced the democracy and science of the local legislation.Therefore,institutional supply of the local legislative research should be enlarged,such as the application of the local legislative research,the choice of the subjects and methods,the procedures and legislative effects of the research,etc.
