On Advance Behavior of the Criminal Law

先行行为产生的作为义务是不纯正不作为犯的作为义务来源之一。先行行为必须是行为人本人实施的,造成特定危险状态的行为。违法行为和合法行为都可以成立先行行为;先行行为也可以是过失犯罪行为,但不能是故意犯罪行为。

The act duty that advance behavior produces is one source of offence of nontypical omission. The advance behavior must belong to the actor himself, creating the specific and dangerous status. The illegal or legal acts may form advance behavior. And the advance behavior may be negligent offense behavior, but cannot intentional offense behavior.
