On the Problem of Matrimonial Property from the Perspective of the Relationship between Law and Morality——A comment on the article XI in the Interpretation of the Marriage Law(Ⅲ)(Exposure Draft)

最高人民法院《关于适用〈中华人民共和国婚姻法〉若干问题的解释(三)(征求意见稿)》自公布以来,引发了很大的争议。本文择取其中第11条,借以管窥我国的夫妻财产制度以及第11条规定背后的问题实质,并从法社会学的角度探析其不合理性。

Since the Interpretation of Several Questions in the Application of the Marriage Law （III） （ Exposure Draft） was issued by the Supreme Court, it has fallen into a heated debate. This essay chooses to study the article XI in order to get a general idea about the essence of the problem covered under the system of matrimonial property in our country and the article XI, and to analyze its unreasonableness from the perspective of sociology of law.
