摘要
劳动合同法第四十八条对违法解雇下的劳动者要求继续履行权做了较为刚性的保护,加之劳动部此前的执法解释又较为严格,这就使得劳动法中的倾斜保护思想偏向于极端,对用人单位过于苛刻。要消除上述消极后果必须加强司法解释的科学性并赋予司法部门更多自由裁量权。
The article 48 of Law on Employment Gontracts provides rigid protection for labor's right to continue performance while wrongful dismissed, and the law enforcement interpretation of Ministry of Labor is relatively strict, therefore, the thought of tilt protection in Law of Labor is extremalized, and becomes severe to employers. The negative influence of legislation can be eliminated by reinforcing judicial interpretation and endowing the judicial department more discretion.
