行动主体视角下新生代农民工维权行动的探讨

On the legal rights of the new generations of migrant farmers

新生代农民工维权行动从个体行动与集体行动两个层面看都存在可能性,但最有效的维权方式是合法的、公开的、有组织的集体行动维权。这种维权方式受到诸多因素影响,如:被标准化的员工生活;新生代农民工城市社会关系不稳定,对劳动关系中的相关法律认识不够;相关法律、法规规定严格,可操作性不强;新生代农民工的法律意识淡薄,等等。

This paper studies the protection of legal rights of the new generations of migrant farmers from the viewpoint of individual and collective activities.It is most effective to take measures in a legal,open and well-organized way,though it is hindered with a number of factors,which may include their highly standardized way of living,unstable urban social relations,and deficient of relevant laws and rules.
