修改制定《医疗损害责任法》的理论研究

Theoretical research on formulation of《Liability Law of Medical Malpractice》

《医疗事故处理条例》存在一些缺陷,导致医患纠纷此起彼伏,需要修改制定《医疗损害责任法》;应该严厉打击医闹行为,允许建立民间医疗事故鉴定组织,修改赔偿标准,对医患纠纷处理情况进行公示,实行医院院长医疗事故问责制,强调卫生行政部门的责任,防范和减少医患纠纷发生,公平公正处理纠纷,促进医患和谐。

Medical disputes has raised sharply because of some defects of the 《Regulations on handling of medical accidents》 ,thus we should amend the regulation and formulate《Liability Law of Medical Malpractice》, crack down medical dispute profiteers, establish third-side institutions of Technical Authentication of Medical Accidents, emend compensation standards, han- dle medical disputes publicly, make hospital directors to take administration liabilities for medical accidents, emphasize the re- sponsibilities of the administrative department of health, thus to avoid and reduce the medical disputes, to handle the disputes fairly, and to construct a harmonious hospital and patient relationship.
