中小学乱收费问题严重阻碍了我国教育事业的发展，从法律角度分析，造成这一问题的主要原因在于教育投入未完全纳入法制化轨道，教育法的约束力和可操作性不强。为了真正实现依法治教，解决如小学乱收费问题，必须提高全社会的教育优先意识和依法治教意识，建立完备的教育法规体系，并通过弱化行政干预，完善“司法独立”

Random fee collection in prirnary and middle schools has hindered the development of education in our country. In the eye of law, the problem mainly results from the educational impt no being entirely put on the legal system and education Law being short of binding force and operation. In order to 'Rule Education by Law' thoroughly and resolve the problem of collecting fee at random, it is necessary to improve the consciousness of education being prior and ruled by law, and to built perfect educational law system. Furthermore,executory effect of education law ought to be strengthened through softening adrninistrative intervntion and inproving' Independence of Jurisdiction'.
