论我国产品责任法体系的构建

On Constructing Product Liability Law System in China

我国没有专门的产品责任单行法,有关产品责任的法律规范主要有《中华人民共和国民法通则》、《中华人民共和国产品质量法》和《中华人民共和国侵权责任法》。纵观上述立法,存在着诸如销售者责任归责原则立法矛盾,立法滞后于发达的市场经济的需求,立法类别多而杂等问题。要解决上述问题,唯有制定专门的产品责任法,完善产品责任法体系,加强中国产品质量的法制监管,提高中国产品质量,并且要进一步加强对国内消费者权益的保护。

There are no specific regulations concerning product liability in our country,except some clauses stipulated in General Principles of the Civil Law of the PRC,Product Quality Law of the PRC and the Tort Law of PRC which was enacted on July 1th last year.Reviewing former regulations,we can find a lot of problems,such as：the antinomy of product liability of salesman,the legislation lagging behind the demand of market economy,the miscellaneous category of legislations and and so on.Therefore,only by means of enacting the Chinese Product Liability Law and establishing the product liability legal system can we enhance food safety supervision,improve the quality of Chinese products,and further protect consumers＇ benefit.
