超越之后的困惑——论近现代湖南人法制思想的时代性与局限性

Bewildering after Transcendence ——On the Epochal Character and Limits of Legal Thoughts of Contemporary Hunan Figures

湖南籍的近现代人物中,虽没有出现像沈家本那样的法学大家,但从王夫之到魏源、曾国藩、谭嗣同、宋教仁、黄兴以及毛泽东、李达、胡耀邦等人,其思想体系中包含了许多重要的法制思想。在当时的中国,或是开风气之先,或是引领着中国法制思想的发展方向,湘籍人物法治思想的一个共同特点是具有鲜明的时代性。当然湘籍人物的法制思想中也存在着明显的历史局限性。湘籍人物在法制思想上的种种局限性,对我国引进西方法治文明、健全中国法制造成了一定的消极影响。

Though there are no great jurists like Shen Jiaben,which among the contemporary figures born in Hunan,there are persons like Wang Fuzi,Wei Yuan,Zeng Guofan,Tan Sitong,Song Jiaoren,Huang Hsing,Li Da and Hu Yaobang,which have put forward many important legal thoughts,moreover,which either leaded the fashion or direct the development of contemporary legal thoughts.The common feature of the legal thoughts of the people born in Hunan is its temporal spirit.However,the legal thoughts of figures born in Hunan have their apparent historical limitations.
