第三部门的功能异化及其矫治——经济法视野下的社会团体

The Function Alienation of the Third Sector and How to Correct it—A Study of Social Groups in the Perspective of Economic Law

第三部门是指非政府组织和非营利性组织的集合与统称。第三部门的出现,主要是为了在国家公共权力与个人自治权利之间取得一个平衡点,使国家、社会、个人三者形成相互制约又相互依赖的良性互动。但在我国,第三部门的发展出现了功能异化的倾向,丧失了独立性、自主性和客观中立性,同时,我国的现行法律制度也制约了它的健康发展。因此,必须通过完善相关立法,重构第三部门的组织机构,加强内部民主化,建立第三部门与其他部门的良性互动机制来予以矫治。

Non-governmental organizations and non-profit organizations are collectively called as the third sector. The third sector came from the balance of a state power and a individual right to autonomy, because there are of interdependent and inter-restricted relationship between them. But in China there exists a tendency of function alienation of the third sector, such as lack of independence, autonomy and neutralism, at the same time the currents laws of China have restricted the development of the third sector. Therefore, we should take the following measures to correct them：to perfect related legislation, to reconstruct the organization of the third sector, to strengthen its inner democracy, to build a benign interaction system between the third sector and the other two sectors.
