集体土地制度理论基础分析

摘要 在法律概念里,农村属于劳动群众集体所有的土地叫集体土地。对目前中国农民而言,土地承包经营权仍然是其生存、发展的基础,具有社会保障功能。土地产权是所有制关系的法律形态,赋予农民对承包地的归属权、占有权、处分权、使用权等以及实施这些权能所产生的收益权,是健全完善土地承包经营权流转市场的前提条件,在此理论基础上提出了培育集体土地权益保障市场退出机制的几点建议。 In terms of law,collective land in rural areas is the land collectively owned by the workers.For China's farmers,the operation rights for the leased land are the basis of their survival and development,displaying social security functions.Land proprietorship is a legal form in ownership.A precondition for improving land lease operation flowing is to provide farmers with benefits from the ownership,possession,handling and use concerned.Based on this assumption the current research proposes some ways for the security market opt-out of collective land benefits.
