检察机关人民监督员制度实施研究

检察机关人民监督员制度的试点工作取得了较大的成效,也存在着问题和不足。2010年新规定使人民监督员的选任更加体现人民代表性,选任程序更加规范,监督程序更加科学合理。建议上级检察机关选任人民监督员和组织案件监督坚持统一性与地方性相结合,切实落实检察机关人民监督员办事机构的职能,加强与检察机关内部检务监察的协调,对原"五种情形"的监督程序要进一步完善,努力扩大人民监督员工作的范围,提高人民监督员的履职能力。

The people＇s supervisor system has made a great progress,but also has some problems and the insufficiency.The new stipulation in 2010 is more representative,more standard,and more scientific.The author made a suggestion that the higher procuratorial organ should combine the unity and local trait in appointing the people＇s supervisor and inspecting the organization case,carry out the function of in people＇s supervisor the procuratorial organ gency strengthen the coordination in the supervision inside the procuratorial organ,further perfect the supervising process of＂five situations＂,expand the scope of the people＇s supervisor work,and improve the people＇s supervisor＇s duty ability.
