Research on the Major Legal Issues of Tort Liability Law Implementation

《侵权责任法》在实施过程中遇到了一些重大问题亟待解决,包括侵权责任法在民法体系中的位置,与其他法律的协调,关于侵权责任法归责原则的理解,关于特殊主体的侵权责任,关于特殊责任的类型化。对于这些问题应当妥善地解决,并且,以这些重大问题的解决为基础,带动其他小问题的修正与完善,从而为以后的民法典编纂奠定基础。

In the process of implementation,Tort Liability Law faces some major issues which require immediate solution,including Tort Liability Law's position in civil law system,its coordination with other laws,understanding of Tort Liability Law imputation principle,tort liability of special subjects,typification of special responsibilities.These major issues shall be properly solved,and based on the solution,we can further correct and perfect other minor problems,thus lay a foundation for Civil Code compiling.
