试论经济法视野下政府失灵的克服

On Overcoming of Government Failure in View of Economic Law

市场失灵为政府的积极干预成为必要,同时我们也发现,政府对经济的干预并非总是积极有效的。政府的有限理性加之其具有经济人的特质因此极易陷入干预失灵的泥潭。正是由于市场失灵和政府失灵的双重困境才建构了经济法的逻辑基点。本文以政府失灵为主题,首先从政府失灵在我国的主要表现为切入点,然后分析其产生的原因并从经济法的角度提出规范措施,旨在使政府干预在经济法的规制下实现政府功能和市场功能良性互动。

Market failure for the government＇s active intervention to be necessary,but we also found that government intervention in the economy is not always positive and effective.As the Government＇s limited rationality coupled with the nature of economic man as easily fall into the quagmire of failed intervention,that there are failures of government intervention in the same objective may be.It is because of market failure and government failure to construct the dual dilemma of economic law was the logical starting point.In this paper,the theme of government failure,the first from government failure in China mainly as an entry point,and then analyze the causes and economic law from the standpoint of preventive measures designed to make government intervention in economic law to achieve the government＇s regulatory functions positive interaction and marketing functions.
