Legal Transplant:An Important Form of Dimension in Restructuring Legal Culture

法律引进和移植是法律文化全球性重构的重要形式向度,近年来在成文法典、法律规范、法律意识和法律制度等方面,都已实施了法律引进和移植。这个文化实践过程包括了引进、输入、接受、选择、融合等形态,揭示了法律文化重构是一个动态发展的过程,动态性既体现在它的发生、发展直至最终实现当中,又体现在引进和移植先进的外来的法律文化和输出优秀的本土的法律文明的互动过程中。

Both legal introduction and transplant are important forms of dimension in the global re- construction of legal culture, which has been realized in such realms as statutory law, legal standardiza- tion, legal consciousness, and legal systems in recent years. This cultural practice involves a procedure of introduction, input, acceptance, selection, mergence, and etc, which proves that the reconstruction of legal culture is a process of dynamic development. Such quality of being dynamic is represented not only in the whole procedure of its occurrence, development and final realization, but also in the interaction be- tween the introduction and transplant of advanced foreign legal culture and the output of glorious domestic legal civilization.
