A History of the Construction of Criminal Reconciliation System in China and a Realistic Consideration on It

中国有着深厚的刑事和解制度生存土壤。历史的"和合"司法观念决定了中国的法制传统可以接纳刑事和解制度;从政治国家向市民社会的变迁则决定了中国社会迫切需要建立刑事和解制度;而国家和个人最大化的效益追求也预示着刑事和解制度的建立已成为了国家和个人的内在需求。刑事和解制度不但能够在中国建立,而且完全有必要在中国推广。

China has rich resources for the system of criminal reconciliation. The concept of ＂harmony＂ in history about judicature by the Chinese people determines the acceptability of this system in China, and the change from political state to civil society ensures the urgent need to construct the system in the country. Moreover, to pursuit the highest effectiveness of judicature indicates that there is the domestic need of the country and the people to establish the criminal reconciliation system. This system can not only be established in China, but also be popularized in the country.
