摘要
现代婚姻是基于情感、责任、道德之上进行男女择配的制度性安排,是一种社会规范在制度上的体现。而婚外情(ultra-marriage love)违背婚姻制度,对婚姻当事人及其家庭造成伤害,从而引发诸多社会问题。婚外情的主要矛盾是情感与婚姻制度矛盾,对此世界各国试图通过立法来解决婚姻纠纷,然而情与法的冲突是永远解决不了的问题。但在苗族的传统上却成功地解决了婚姻与情感的问题,通过射背牌使有情人各安其份,回归现实的婚姻家庭。这是苗族对婚外情的智慧处置,比起制度性惩罚来得高明。
Based on emotion, responsibility and morality, contemporary marriage is institutional arrangement for choosing a mate and a realization of social norm in system. Ultra-marriage love disobeys marriage system, hurts the persons involved, and thus has led to numerous social problems. The principal contradiction of ultra- marriage love lies in the contradiction of emotion and marriage system. In order to solve this problem, many countries appeal to legislation. Nevertheless, the conflict between emotion and law can never be solved. In the Miao tradition, there is a successful solution to this problem. By Shooting Beipai, lovers come to be law-abiding and return to their own families. Shooting Beipai is an intelligent solution to ultra-marriage love by the Miao people, which is much wiser than institutional punishment.
