摘要
我国行政复议制度并未涉及行政指导行为是否具有可复议性,但由于行政诉讼制度将行政指导行为明确排除在受案范围之外,尤其是不适当地强调行政指导行为的非强制性以及行政复议制度与行政诉讼制度的衔接,行政指导行为一直被排斥在行政复议的大门之外。从严格依法行政的角度看,将行政指导行为纳入行政救济范围不仅具有现实必要性,而且与我国行政复议制度也具有高度的契合性。依托行政救济机制,国家可对行政指导行为进行合法性审查与合理性审查,并可实现包括信赖利益和期待利益在内的相对人的权益保护。
China's administrative reconsideration system does not touch the reconsiderability of administrative guidance,but as administrative litigation system excludes administrative guidance,especially its undue stress on the non-compulsoriness of administrative guidance and the link between administrative reconsideration system and administrative litigation system,administrative guidance is excluded from administrative reconsideration. From the angle of administration of law,it is not only necessary but also highly suitable to bring administrative guidance into the scope of administrative relief.The administrative relief mechanism not only facilitates the inspection of legitimacy and rationality of administrative guidance,but protects all the parties that trust and expect interest.
