信访投诉纳入行政复议范围的法理论纲 被引量:2

摘要 行政机关的信访处理行为应当纳入行政复议的范围,因为信访是否可以纳入行政复议的范畴,根本上取决于信访本身的属性及其与复议和诉讼的关系。具体而言,信访作为监督和(特殊)救济机制,是行政机关履行职责的重要组成部分。行政机关的信访处理获得是针对信访投诉所做的具体行政行为,符合行政复议的受案条件。此外,从信访、复议和诉讼的关系来看,信访既不应是超越于法律监督和救济制度之上的机制,也不应当是独立于法律监督和救济之外的机制,它只能是在法律范畴内、能够与既有法律监督和救济机制相衔接的机制。 The governmental treatment of complaints should be seen as administrative reconsideration,for whether complaints can be brought into administrative reconsideration depends on their property and their relation with reconsideration and lawsuit.As the supervision and(special) relief mechanism,complaints treatment is an essential part of administrative duties.The acceptance of complaints is the concrete administrative behavior done to complainants,thus meeting the condition of administrative reconsideration.In addition,the administrative treatment of complaints,in line with the relation between complaints,reconsideration and litigation, should neither go beyond nor be independent of the supervision of law and the mechanism of relief system. Instead,it can only be a mechanism matching the current laws and relief system.
