食品业产品责任保险制度研究——中国台湾食品业强制保险立法的启示

中国大陆在2008年间出现婴儿食用三鹿牌奶粉导致的食品安全事件。中国台湾在2011年5月掀起了塑化剂食品危害健康的风波。为此,该如何应对食品风险危害以免于消费市场失序成为食品业亟待解决的问题。食品瑕疵造成的风险会危害到众多层面,如食品业、消费者及消费市场秩序等。因此,理性的食品业应投保产品责任保险,其价值取向包括取代食品业的民事赔偿责任、消费者直接向保险公司请求赔偿和巩固消费市场的经济秩序。

An incident concerned ＂poison milk powder＂ that happened in Mainland of China in 2008,and another incident concerned ＂plasticizer health hazards of food crisis＂ that were discovered in Taiwan on May in 2011.So how to deal with the food risk hazards to avoid the consumer market disorder is the urgent problem.Food flaws risk is a danger to many aspects,such as food industry,consumers and the consumption market order,etc.Therefore,the reasonable food industry should insure the product liability insurance,and its value orientation includes it can replace the civil liability for compensation of food industry,consumers can claim for compensation directly to the insurance company and we can consolidate consumption market economic order.
