From Concept to System——Review of Research on Tourism Law

旅游法理念是旅游法的精神和灵魂,旅游法宗旨是旅游法理念的现实表达,我国旅游法宗旨未能有效表达旅游法理念,反映旅游本质属性。根据公私法划分的理论,旅游基本法不能囊括旅游业所有业务范围,只能调整宏观、纵向的旅游法律关系。学者对旅行社质量保证金、旅游合同法的研究较为深入,但对旅行社法、旅游饭店法及地方旅游立法的研究上时代性和创新性不足,有待加强。

Concept is the spirit and soul of tourism law. Aim of tourism law is the real express of that. In our country, aim of tourism law does not effectively express the concept or reflect tour essential attribute. Under the theory of public and private law, the basic tourism law can＇t cover all the scope of tour business, but only adjust macroscopic and longitudinal legal relation. Scholars have deeply researched the quality seenrity regulations, but let research an travel agency and hotel and local legislation still undeveloped timely and innovatively which need to be strengthened.
