Convergence of Legal Responsibility of Anti-drug Law and Other Legal Responsibilities

《禁毒法》立法有适度超前性。以《禁毒法》部分刑事法律责任条款为研究视角,从犯罪构成体系、犯罪特征及相关条款的历史渊源进行分析,探讨《禁毒法》与《刑法》《治安管理处罚法》之间的法律责任衔接问题,以期更好地完善惩治毒品违法犯罪的法律体系,指导涉毒执法实践中的法律适用,充分发挥《禁毒法》作为打击涉毒违法犯罪行为的基本法的作用。

The legislation of Anti-drug Law is relatively advanced.This paper,from the view of some terms of criminal law responsibility of Anti-drug Law,makes an analysis on the crime committing system,crime feature and the historical origin of the related terms.It discusses the convergence of legal responsibilities of Anti-drug Law,Criminal Law and Public Security Administration Law,which is in the hope of perfecting the legal system of the punishment of drug crimes,applying the law in the practice of drug-related law enforcement and giving a full play of Anti-drug Law to combat drug-related crimes.
