与公民的生存权和健康权关联紧密的药品价格问题是医药卫生体制改革中的焦点和难点问题。文章指出,应改变现行公立医院药品价格机制的制度理念,重构制度系统,确立法律制度在公立医院药品价格机制中的基础性地位,通过法律制度对政府与市场关系的界定来保障市场规则有效运行。

Medicine price, which closely related to rights of life and heahh, is a focus of medicine and health system reform. This paper points out that it is necessary to reconstruct the system, to establish the basic status of legal system, and to ensure the market rules run in good order by defining the relationship of legal system on government and market.
