摘要
在对传统民法宣告死亡制度进行研究的基础上,引入植物人宣告死亡制度,并对这一制度的概念、特征、适用条件、法律效果进行比较、说明和解释,以此力求在遵循现有民法理论之前提下,充分实现植物人财产之经济价值。
Based on the research of traditional system of declaration of death,the system of declaration of death of vegetative patient is introduced,and the concepts,characteristics,applicable conditions and legal effects of the system are compared,described and interpreted.Following the premise of the existing civil law,the full realization of the economic value of the vegetative state property would be ensured.
