美国《加利福尼亚州反狗仔队法》述评及其启示

Review on the California's Statute "Anti-Paparazzi"

新闻自由与隐私保护历来存在着矛盾与冲突,特别是在现今收集新闻的技术手段日益先进的信息社会,这一矛盾与冲突更是加剧了。美国《加利福尼亚州反狗仔队法》对美国传统隐私权法加以改造,以革新的方式去应对变革的技术,通过运用法律去影响其他的行为约束方式,以间接的方式来保护隐私。这一思路和制度对我国的相关立法具有重要启示。

The conflicts between the freedom of the press and the privacy protection have existed for a long time. The conflicts have been aggravated by the current information society with the more advanced technology used for collecting news. By amending the traditional American Privacy Laws, the California＇s statute ＂Ant-Paparazzi＂ makes a great contribution to protect the privacy indirectly with the innovative approach to deal with the improving technology, and with the laws to control or place limits on people＇s behavior. Therefore, this system has been greatly significant and important for the relevant legislations in China.
