我国餐饮服务食品安全执法的主要形式分析

Study on the main pattern of the food safety law enforcement

我国餐饮服务食品安全执法的形式主要有两种:餐饮食品与卫生监督分开执法,餐饮食品与卫生监督合并执法。本文分析了这两种执法形式的利弊,结合"瘦肉精"等多起食品安全事件暴露出的监管问题进行分析,建议我国餐饮服务食品安全在短期内实行卫生监督一支队伍执法,建立多层协调机制。随着大部制改革进程的加快,我国应适时修改《食品安全法》,对食品生产、流通和消费等涉及食品安全的全过程实行一个部门监管,一支队伍综合执法。

The two principal patterns of the food safety regulatory system are the ＂combined law enforcement＂ and ＂separately law enforcement＂ respectively. This paper analyzes the advantages and disadvantages of the two patterns, with example of clenbuterol and other food safety accidents from exposure to regulatory issues. It recommendations that the food service food safety supervision and management should be retained a regulatory body and establish multiple coordination mechanism in the short term. With the acceleration of establishing the superministries, ＂Food Safety Law＂ should be timely modify and the entire food safety supervision should be implemented by a signal sector management and a team of law enforcement.
