On Advisory Enforcement in Road Traffic Administrative Management:Based on a Minor Breach Case Exempted From Punishment

"劝告式执法"作为一种与"以人为本"执政理念相关联的行政管理创新,具有规范层面上的合法性与合目的性。它以"要件—劝告—效果"关联架构成立为前提,对轻微违法行为"经劝告后纠正、未造成危害后果"而"不罚"。其应通过正当程序作出,并限制过度自由裁量,从而作为一种补充性的执法制度通过合作治理真正实现道路交通安全法的立法目的。

Advisory enforcement,as a creation in administrative management which is relevant with the people oriented theory,meets the needs of legality and ZweckmaBigkeit（purposiveness）.It exempts the administrative counterpart from punishment for minor breach of law,on the premise of ＂requirement— advise—effect＂ related structure.This system should be carried out due process,and we should place restrictions excessive discretion,so as to guarantee the legislative purpose of traffic safety.
