论京族海域使用习惯法与现行海域使用权制度的冲突和调适

Conflict and Adjustment between the Customary Law for Using Sea Areas in the Jing Nationality Region and the Current Rights of Using Sea Areas

京族是我国唯一的海洋民族,世代从事海洋渔业生产,形成了海域使用习惯法。《海域法》出台后,国家以海域使用权制度调整全国的海水养殖业。京族海域使用习惯法与我国海域使用权制度存在的冲突,应实现习惯法与现行制度的调适,完善我国海域使用权制度。

The Jing nationality is the only marine nationality in our country that engage in fishery industry from generation to generation thus forming the customary law for using sea areas. After the issue of the Sea Area Law, our country adjusts the sea farming according to the rights of using sea areas. However, the customary law for using sea areas in the Jing nationality region conflicts with the current rights of using sea area, it should make the adjustments between the customary law and the current rights of using sea areas thus improving the rights of using sea areas in our country.
