摘要
近代西方刑法哲学流派繁多,理论格局错综复杂,从时间维度及学术派别的角度可大致将其演变梳理为三大主要线索:走向启蒙的刑法哲学、趋于思辨的刑法哲学、转向实证的刑法哲学。近代西方刑法哲学的基本精神主要包括:追求功利、守护正义、捍卫人道。
There are many schools of modern Western philosophy of criminal law, the pattern of theory is very complex, from the perspective of the time dimension and academic factions, its evolution can be roughly sort into three main clues： philosophy of criminal law towards enlightenment, philosophy of criminal law tends to speculative, philosophy of criminal law turned to the evidence of a crime. The basic spirit of modern Western philosophy of criminal law can be mainly summarized as ： the pursuit of material gain, guardian of justice, to defend humanity.
