摘要
陪审制度既是一项民主政治制度,也是一项司法制度,其中陪审员的任职资格和选任程序是陪审制度的关键所在。本文首先阐明了陪审员选任制度的功能,而后,对中国陪审员遴选制度进行分析,并提出完善中国陪审员选任制度的方案。
Jury system is not only democratic system but also judicial syetem. The appointments proce- dures to qualifications of juror is very important. In this article, the author firstly clarifies the function of the election measures of juror, then, analyzes the election measures of juror in China, thirdly, puts for- ward some suggestions about perfecting the election measures of juror.
