以哲学诠释学为视角分析作为存在意义的法律解释,能够发现法学前见作为法律解释前提存在的必然性。因此,法律解释学应恢复前见的合法地位,在法律解释的视域融合过程中领悟相对客观的法律真理,剔除不合法前见,使前见不断向前发展。法学前见包含着丰富的内容,凸显了法律职业共同体的核心价值,而法学前见的特征表现为历史性、开放性、创造性、实践理性和客观性等几个方面,其中,法学前见的客观性对于实现法治理想具有重要意义。

Current hermeneutics has entered the era of Philosophical Hermeneueutics. If analyzing the legal interpretation in the meaning of existence from the perspective of the Philosophical Hermeneneutics, we can find the inevitability of the Vorurteil of law as the legal interpretation premise. The Legal Hermeneneutics shall resume its legal status, illuminate the relative objective legal truth, and eliminate the illegal Vorurteil to make it develop in the process fusing horizons of the legal interpretation. Among them the objectivity of the Vorurteil of law has important significance for the realization of legal ideal.
