Analysis of Legislation Idea of Minors Protection Law

有关未成年人的立法,不应仅限于形式描述,应着眼于立法观念的分析。从发生论分析,应该树立未成年人权利至上的立法观念;从运行论分析,应该具备必要的限定认识观念。当然,认识与尊重未成年人问题的规律,是未成年人法立法观念树立的根基。

We should focus on the analysis of the legislation idea of minors protection law, instead of being limit- ed by the formal description. Analysing the cause of minors protection law, we should set up the legislative idea that the minor＇ s fight is supreme. Analysing the operation of minors protection law, We should realize that we are now living in a plural society,we are facing some real constraints in the implementation of minors protection law. Of course, the legislation idea of minors protection law is based on clearly recognizing and respecting some regular rules of mi nor＇ s problems.
