我国海洋生物资源养护的立法初探

Study on legislation of curing of marine biological resources in China

海洋资源的有限性与人类需求的无限性在客观上要求我们必须合理保护与利用海洋资源,而达成这一要求的基本前提是法律的构建与规范。目前我国在相关法律体系建设上发展较快,但仍然存在一些硬伤,其中较为突出的问题是对我国海洋生物资源养护的立法构建。这也成为制约我国海洋环境保护、发展海洋经济的重要因素。因此,我国应当高度重视对海洋生物资源养护立法,深入了解海洋生物资源养护立法的环境与条件,进而更好地确立立法主体、客体及其内容,使海洋生物资源得以保养、修复和预防。

Due to the limited marine resources and the unlimited needs of human, that requires us to protect and use marine resources reasonably. And the basic premise of achieving this requirement is the construction and norm of the law. Currently China＇s legal system construction is developing fast, but still there are some flaws. Some prominent ones of them is the problem of our country＇s legislative building about curing marine biological resources. This also becomes to an important factor of protecting the marine environment and developing China＇s marine economy. So we should pay much more attention to marine biological resources＇ curing and legislation, deeply understanding the environment and conditions of the marine biological resources. And then we can be better to confirm the legislation body, legislation object and legislation content, in order to maintain, repair and prevent the marine biological resources.
