海洋开发过程中,由于开发与保护的失衡,整个海洋渔业的生存与发展受到了较大的威胁与挑战,长期从事海洋渔业捕捞、养殖的广大渔民正面临着"失海"和由此而导致利益受损等一系列问题。论文从保障渔民根本利益的角度,阐述了渔民面临的"失海"问题,渔民由"失海"造成各项权益受损问题的现状及原因,在进行客观综述的同时,分别从法律、社会、出路诸方面提出了对策。

Because the unbalanced development and protection during ocean exploitation, the marine fishery, the survival and development of threats and challenges, the fishermen face with the ＂sea lost＂ and thus led directly to loss of their rights and interests, it is also affect social stability and harmony. From the angle of the fishermen fundamental interests guarantee, the paper expounds the ＂lost＂ sea issue fishermen rights issues, including the status and countermeasures.
