恐怖活动犯罪界定问题思考

A Study on the Definition of the Crime of Terrorist Activities

针对《刑法修正案(八)》对特殊累犯的规定中有关恐怖活动犯罪含义不明的问题,提出应从罪刑法定的刑法基本原则出发,采用规范分析法为主,结合背景分析的方法,试图对其中的恐怖活动犯罪的界定问题作分析思考,并提出认定的设想和建议。

The definition of the crime of terrorist activities is not clear in the stipulations on special recidi- vism in The Eighth Revised Bill of The Criminal Law of PRC. Therefore, starting from the fundamental principles of crime and penalty as the laws defined, this paper proposes that we should adopt the method of normative analysis together with the method of background analysis, and attempt to have a careful consideration on the definition of the crime of terrorist activities, so as to put forward some relevant plans and suggestions.
