Application Research on Performance Margin Guarantee Money in National Defense Contract

阐述了履约保证金与定金和投标保证金的区别，分析了履约保证金的法律性质，并对现行国内外履约担保模式进行了比较，论证了其在我国国防合同应用的必要性和可行性。

This paper introduced the differences between performance guarantee money with the earnest money and bid guar- antee money, and compared with the mode of performance bonding at home and abroad. And through analyzing the law property of performance margin guarantee money, the result demonstrates the necessity and possibility of Chinese national defense contract which is used in performance margin guarantee money.
