唐宋录事参军法定职能演变探究

On Evolution of Lushi Canjun’s Legal Functions in the Tang and Song Dynasties

由唐入宋,作为州府主要官员的录事参军,在职能定位上发生重要转变。盛唐时期,录事参军主要以监督为职。安史之乱后,录事参军逐渐获得了参与政务的职权。北宋时期,录事参军的政务官尤其是司法官身份不断强化,而传统的监督官身份在淡化;到南宋时期,录事参军终于演变成以断狱为职的专职司法官。从社会治理的层面分析,唐宋之间录事参军职能转变可谓这一时期地方治理模式转变的法律表现。

From the Tang to the Song, the legal functions of Lushi Canjun, one of the main official posts in the prefectural government, underwent tremendous changes. In the prime period of the Tang, it was mainly a post of supervision. After the An ＆ Shi＇s rebellion, Lushi Canjun was gradually allowed to assume governing functions. In the Song Dynasty, Lushi Canjun was endowed with plural functions especially those of judiciary. In the Southern Song it became the sheriff exclusively settling lawsuits. From the evolution of Lushi Canjun＇s functions, we can find the transformation of the local governance regime between the Tang and the Song dynasties.
