摘要
形象权是指民事主体对其形象的姓名、肖像、声音等形象因素进行商业性使用的一种排他性财产权利。中国尚未建立起形象权法制体系,形象权理论的研究还处于起步阶段,因此,有必要在中国建立起形象权法律制度,以填补现阶段法律的空白。
The right of publicity is such a right that the main civil can make benefit by controlling the business use of its own identified characteristics such as name, portrait and voice, which exclude others from interfering in. The legal system of publicity right has not been built yet in China. The research of the theory is just beginning. Therefore, it is necessary to build the legal system of publicity rights in China.
