摘要
食品安全是一个系统工程,它涉及到有关食品安全法律是否完善,涉及到执法者能否有法必依、执法必严、违法必究,涉及到经营者的道德和自律水平,涉及到社会的监督机制是否完善。但就总体而言,执法不力,有法不依、执法不严、违法不究是影响目前中国食品安全问题的症结所在。而在执法环节又涉及两个方面,一是执法机构设置,二是执法的工作机制。回顾中国食品安全执法体制的变迁,反思我国食品安全执法体制过程中执法机构设置和执法的工作机制存在的问题,在此基础上对我国食品安全执法体制的完善提出建议。
The issue of food safety is a systematic project which concerns the completion of the food safety statutes,the moral standards,the self-discipline of the industry as well as the social supervision.However,ineffective law enforcement is the crucial reason for the issue food safety.The installation of related government institutions and operating mechanism of law enforcement are very important in the process of law enforcement.This paper reviews the changes of food safety enforcement system,reflects over the problems in institution installation and operating mechanism of law enforcement.In the end,it offers advices for China food safety enforcement system.
