摘要
《劳动合同法》的实施引发了社会各界广泛的争论,从《劳动合同法》对劳动关系领域的变革入手,分析其对企业和劳动者产生的影响,得出"这些影响是《劳动合同法》引起争议的原因"这一结论。并由此出发,探讨劳动领域立法应考虑的法理要素和现实要素,其中的现实要素包含了劳动立法的国际化和本土化。这二者的和谐统一,是劳动领域立法走向完善的方向。
The implementation of the "Labor Contract Law" has triggered widespread debates in all circles in the society. Starting with the change in the labor relation domain, we analyze the impact on enterprises laborers, arriving at a conclusion that these impacts are the cause to spark the debates of the "Labor Contract Law". When dealing with legislation in the labor field, we should consider both legal elements and actual elements, of which the actual elements encompass the internationalization and localization of labor legislation. The harmonious unification of the two is the orientation in which the legislation in the labor domain moves toward perfection.
