Starting from the cases of out-of-railway casualty that are the most difficult to handle in the practice of rail-way justice, at the base of analyzing disputes on doctrine of liability fixation, law application, excusation about these cases, the article researches problems of dispute cases of payment incurred for person injure of railway transport in theory and practice with the law of tort liability and the regulations of new judicial interpretations by the Supreme People＇s Court, in order to help correct processing dispute cases of payment incurred for person injure of railway.
