模因特性视角下的数字化图书馆复制权运行风险及其规避探析

模因是一种信息单位,它靠模仿、复制、传播而得以生存,具有可复制性、传播性、排他性和社会性。文献复制权是图书馆数字化过程中涉及知识产权问题最多的一种权利。网络环境下文献复制得到无限扩张,复制方便了用户的使用,拓展了图书馆的服务范围和功能,但同时也存在运行风险。模因特性视角下,应通过平衡各方利益关系、加强著作权法律法规建设等措施来规避数字化图书馆复制权运行风险。

Meme is a unit of information, involving in imitation, replication and transmission, which has attributes of explicability, transmissibility, excludability and sociality. The right of literature reproduction has the highest correlation to the intellectual property right in library digitized process. Although the literature reproduction facilitates users and extends the service content and functions, the indefinite expansion of literature reproduction in the network environment remains risky. From the view of mete characteristics, the operation risk should be prevented or avoided by balancing the benefits of the parties concerned and strengthening the laws and regulations construction of copyright.
