历史逻辑与法治逻辑的交融——评翁有为教授的专著《专区与地区政府法制研究》

当前我国的省直管县、扩权强县的举措与争论,[1]不仅牵涉到中央与地方的关系问题,而且涉及了省、市、县、乡镇的地方行政建制与组织财政权力配置的问题。这些问题都紧紧地和我国的行政组织法制建设、宪政建设与法治建设联系着。对于这些问题的思考,不仅需要法治逻辑,而且也要有历史的逻辑。而时下的讨论更侧重于前者,对后者的关注较少。在笔者看来,翁有为教授的专著《专区与地区政府法制研究》较好地体现了历史逻辑与法治逻辑的融合,
