On the Legal Environment of International Cooperation for China Manned Space Station

国际合作原则是国际法和外层空间法上的基本原则。概括分析了国际空间合作的一般原则、理念和现实,提出中国载人空间站国际合作法律框架构建的主要问题,即应在遵守主要外空条约的基础上,根据各国的参与程度,设计国际空间合作的基本法来规范合作的一般性重大问题,辅之以双边合作协议或者谅解备忘录来规定具体合作内容。空间合作的法律既要适应现实需要,又要具有前瞻性,特别是应对日益发展的空间商业化利用的要求。

The principle of international cooperation is a fundamental principle in both international law and outer space law. China Manned Space Engineering Project should establish a legal framework for international cooperation. Complying with outer space treaties and considering the degree of international participation, China should enact a basic law to regulate important principles for international space cooperation. The basic law should be supplemented by bilateral agreements or MOUs which will provide the details for cooperation. The space cooperation law should be both realistic and prospective, taking the demand of space commercialization into consideration.
