征地制度改革的回顾与思考

Review and Discussion on Land Acquisition Reform

研究目的：梳理征地制度改革历程，思考征地制度改革方向。研究方法：文献综述法，归纳总结法。研究结果：征地制度改革经过多年的探索，取得了很大成绩，但仍然存在许多不足。现行的补偿模式及补偿标准还可以进一步向市场化方向改进。今后可以从缩小征地范围、改革征地定价方式、完善征地程序等三方面对征地制度进行改革。研究结论：建议今后征地制度改革按照党的十七届三中全会提出的路线继续深入，参照《国有土地上房屋征收与补偿条例》明确征地范围，在补偿标准的制定上采取市场定价，征地程序由“单边程序”到位向“双边程序”到位转变。

The paper systematically reviewed the reform history of land acquisition in China. The history could be divided into three stages regarding the emblematical millstones of the evolution. The paper argued that land acquisition institution Had been ameliorated to some extent in the past years; however it still had some limitation, such as the compensation was still according to the original use and the standard defined by the government; the governmental standard was difficult to link with the unified yield revenue in a year; and the performance was poor regarding the policy of re-defined scope of land acquisition power could be used. The paper concluded with preliminarily designed the possible land acquisition reform, i.e., further re-defining the scope of land acquisition power, changing pricing mechanism of the land, and completing the procedures of land acquisition.
